Norwalk: Police Department Rocked By Latest Allegations

Police Chief Harry Rilling has another scandal on his hands, this time concerning more allegations of sexual encounters by Thomas Cummings. From the Hour:

A gay city police lieutenant was arrested Tuesday for allegedly enticing three 15-year-old boys and having sex with two of them in his Norwalk apartment, after a three-month investigation by Stamford prosecutors.

Lt. Thomas Cummings, 46, may have used the extra-duty job he worked often as Norwalk High School security to meet and seduce boys, according to three arrest warrants filed at Stamford Superior Court.

The lieutenant, a 24-year department veteran and former Detective Bureau commander, turned himself in Tuesday morning at Stamford police headquarters and was charged with eight felonies. He faces up to 115 years in jail if convicted.

The arrest warrant affidavits, authored by Stamford State’s Attorney’s Office Inspector Pat Mooney and signed on Monday by a judge, allege that Cummings’ sexual conduct with young teens had been “ongoing for several years” — at least back to 2003.

Investigators allegedly found and seized 143 pornographic VHS tapes and 110 pornographic DVDs depicting teenage and 20-something males engaged in oral and anal sex, sometimes in orgies, during a Nov. 1, 2007, warrant search of his Wolfpit Avenue condominium, the affidavits stated.

Cummings has been on paid leave since Oct. 29, 2007, when Police Chief Harry Rilling was first told of the allegations against him, and was suspended without pay immediately after his arrest, according to a written statement released by Rilling on Tuesday.“These allegations are extremely serious and, if found to be true, will be dealt with harshly,” the chief stated. “We have cooperated and worked with the State’s Attorney’s Office from the moment the allegations were brought forth and will continue to do so until final disposition.”

Rilling said the department had no reason in the past to investigate Cummings for inappropriate relationships with minors, and added that the allegations “should not be a reflection on the hard-working, dedicated men and women of the department. The citizens of Norwalk can be confident our commitment to excellence shall not be compromised by this incident.”

Cummings’ arrest is the newest in a series of recent, high-profile scandals in the Norwalk Police Department that include three other officers charged with tampering with evidence, threatening a bar patron with an off-duty gun and groping a woman.

Cummings faces three counts of enticing a minor, a felony carrying a maximum prison term of five years; two counts of second-degree sexual assault, a felony with a maximum 20 years; and three counts of risk of injury to a minor, a felony that also carries a maximum 20 years.

According to the affidavits and a Tuesday written statement by State’s Attorney David I. Cohen, Cummings allegedly used Web sites, specifically Manhunt.net, and chat rooms “to entice minors to his home, where he showed them pornographic materials and engaged in sexual intercourse.”

Cummings’ family posted $75,000 bond — $25,000 for each case — on Tuesday and arraignment in Stamford court is scheduled for Feb. 14.

He is the divorced father of two teenage boys.

“The charges against Mr. Cummings are merely allegations, and he is presumed innocent unless and until proven guilty beyond a reasonable doubt,” Cohen wrote. He declined to comment further.

The fact that some of the allegations center on Cummings’ conduct while working security at Norwalk High raises some more questions about what is really going on there. Teaches have been talking about many problems that surface at Norwalk High that are never looked into by Corda or the central office administration. Sal Corda’s comments are rather interesting about this.

Schools Superintendent Sal Corda said it was “disconcerting” and “distressing” for him as a parent and educator to learn of Cummings’ alleged activities and their connection to Norwalk High.

“We had no indication and no knowledge that anything untoward was going on or obviously we would have done something about it,” Corda said. “We do everything that we can to keep our kids safe. No complaints were filed, no rumors were circulating, nothing at all.”

The comments that BOE posts here generally garner is a direct contradiction to Corda’s assertion that rumours are not in evidence. Corda and Lenny Mecca, the curent Norwalk High principal are asleep at the switch.

This is not to say that things are all that much better over in the Norwalk’s Police Department. Once again the intersection between sex crimes and investigative work has been nonexistent. It was Stamford prosecutors who conducted the investigation, not the Norwalk Internal Affairs. Many issues about staffing, about police condict and about investigations that fall apart have been raised here.

    who writes this guys material it is astounding award winning comments.

    what about the crime Dick while one of our Norwalk cruisers are siting in front of this officers house we in the city could use a couple of cruisers as well.

    The rape in South Norwalk as its told has drawn little attention by patrols what was the reason for this bad area , shady side of the city?

    Who gives a rats ass about this what is there to say? call John over in the vineyard and get his spin? I imagine he has a take on this. Whats left leave it to the courts if he is guilty hire another friggin officer if he is not have him head resume patrol and fight imaginary crime Norwalk seems to have so much of.

    Or just give him a dog about the only member on the force that may want to back him up at this point.

    the here and now whats the comments on the crime and budget Dick they both are connected. Has overtime been depleted completely last round of drug money was spent settling a lawsuit brough against the police dept?

    75,000$ bond for a person accused of raping 3, possibly more boys. Any non-Gov employee with the same charges would be held on a half million, at least. I testified against the Norwalk police dept. in Oct. After I witnessed more than 8 officers break the ribs of a drunk driver. Seven days later the Norwalk police would have a warrant signed to search my house for anything and everything.
    Cash was pocketed by the dirty officers, and I was given a 100,000$ bond for possesion of less the 4 onces(misdemeanor).
    I hope Tom gets the chair!

    Pity is a temperary fix to an escalating situation. When a person takes a job as a civil servant, they should uphold a certain standard. Especially when in law enforcement. Breaking the laws that you are paid to uphold is a sure sign of a self-centered scumbag. The system shows a lack of discipline and respect for its intended purposes. To serve the general good of the community. Not station rapists at the local high school. The message it sends out to the sick individuals like Cummings is ” Join the police, so when you get caught, you get off easy”. Lovely picture to paint for the future of our Nation.
    If Tom got the chair, how many rapist would be applying at your local department?

    East Norwalker, yes, this is very disturbing for all. How many kids have been affected by this cop? How many have been part of this? Will we ever know? When are kids going to understand that its ok to tell? This is heartbreaking and its a travesty by someone so many people trusted. By someone who was supposed to protect these kids and now we find that we have to monitor the behavior of those in charge? What kind of policy does this town have in place that deters people like this from gaining access to our kids? I have searched the city website and found none. Who is responsible for this? Who monitors who we allow to come in contact with our kids?

    It certainly takes the good cop out of the healing process for right now that in itself sucks we have so many good ones. It was suggested this week cop trading cards I know it sounds absurd to most but bear in mind right now police presence has become almost a police sub station at Roodner Court. This day and age demands an officer at most housing complexes but this time the city will probably have to maintain this stance for a long time to come. Its time to hear from our officials a proactive stance is whats needed as in other cities.Its time we see some press that addresses the situation and not simply responds to another crime or problem which has been the case in the past.

    #8-There is a policy that has never been implemented. Maybe someone will take a look in the archives and pull out, dust it off and put it in place. Shouldn’t be too hard to find, if I recall it was just passed last year by the council. Can someone explain what the process is for back ground checks? It would be beneficial if the city makes these guidlines known in advance. How do we know now if one of kids was part of this travesty? Do you think they are going to come out and say that they were a part of all this crap? Do you think thy want their friends to know? So this will be one more thing we will never have the answers to.

    In the late eightys, a NHS gym teacher was caught leaving pornographic material in womens cars and watching them as they returned to the car. He was arrested and fired from his position. I went to school with his son, and played on the same baseball team. Everytime he went up to bat, the other team would scream references to his fathers arrest. Even the coaches. We still took second place. That boy was walking in some very uncomfortable shoes back then and showed unremarkable courage. He was on my team so I took no part in it, and lost all respect for those indviduals who did.
    Now imagine what Officer Cummings is putting his children through. They are probebly being humiliated by everyone at school right now, if they have the nerve to even show. Girlfriends would have dumped them due to the new family image. How are they viewing the future as teenagers right now.
    There are no apollogies that can change this, no form of punishment to right the wrong. How do you give all these children their lives back. I was a very angst individual in NHS. If this had happened when I was there, we might have burned the school down. And some students may feel like that right now. We are responsible for the safety of our children while at school, not the administration or the police.
    Lets send the children the right message and turn this tragedy around by creating a better school and police system.
    The future belongs to the children, not us!

    In all fairness, let us remember that all people in our legal system are innocent until proven guilty. When all the facts are presented,have faith that our judicial system will act appropriately. In the meantime, the important thing is talk to your children.

    Background checks are wonderful, but are only useful if someone has been convicted. In this case, he would have come back with a squeeky clean report. Just a very bad situation all around.

    #13 you are very right on this and kids can be brutal to their peers, we can only hope that Tom’s kids have proper help and are able to overcome this new upset in their lives. I only wish Tom understood what he was doing to his kids. Haven’t they been through enough? #15-background checks would deter many from applying for city jobs that would put them in close proximity with kids. Unfortunately there is nowhere on the city job listings that deters them from even applying. This is in no way against gays, or anyone else but damn shouldn’t the city be responsible enough to post expectations when posting a job? Gays are not always the pers in cases of child molestation. They could be your uncle, your father, a siste, a brother or your best friend. Educate our kids is top priority but the city putting out a warning to these people is also something that needs to be done.

    For those like me who using these articles to research police conduct and corruption. Here is a new topic.
    Law Enforcement- #1 users of ilegal steroids.
    Roid rage has lead these individuals to do some sick things. I had a conversation with a Martial Arts instructor who currently trains about 50 local police officers. These rages have become a problem in class. And some of the officers have been sending phone cam pics of people the have shot or assulted. That is highly illegal and he has instructed them to stop doing so.
    I dont make this up.
    The same dealers these cops use are the same ones selling to our local high school athletes. Professional athletes are taking time from congress to speak on this subject.
    But shouldnt the police face the same scrutiny?

    By the way, anyone who has seen the movie “The Bad Lieutenant”. Severals locals have dubbed Cummings as such. This isnt a joke. Serious matters need serious discussion.

    I hate cops not gays.
    I wish the police force was as diverse as the community. Gays included (they do represent a portion of the local population).
    Reason being, Ive been harassed over twenty years by our fine dept. Yes, never by Cummings. Never by the gay community.
    #19, Ill join you anyday on bashing the Chief, Ive heard some sick rumors about him over the decades. Doesnt make it true, just rumors, until someone makes an arrest. Just like the rumors that these kids are lying.
    If they are, well dont worry. The cops will run these kids and their families through the mill as they have done to others in the past.
    Ill even apologise for my remarkes about Cummings. I am human.
    But for someone getting railroaded from the inside, a 75,000$ is remarkably low.
    Several pounds of weed will get you 500,000$ bond in CT. Several rapes, 75,000$
    #19, my goal is to compare the unfair treatment of the average citizen, to a states employee. They pit the poor against poor and leave us with broken families while theirs gets rich. I never recieved special treatment in court as Cummings may.
    I dont want to shutdown the police dept. I still need someone to get my cat out of the tree. But I do want people to admit that we need a change in the duties of the police and how they interact with the community.

    A probable cause hearing is normal for any officer accused of a crime. It seems to me that this was handled per protocol. He was suspended with pay as is the norm and then when the hearing turned up evidence that the charges have some validity he was arrested and suspended without pay as is the norm. The amount of his bail is in the hands of the judge who levied it. Innocent until proven guilty is where we are at the moment. We can all sit and speculate but we don’t have all the answers yet. Watching the news it was indicated that the reporter had copies of the charges in her possession from which she read the charges. Whatever one thinks of the Chief, I doubt he would compromise his newly gained contract extention to make this officer look bad. There are those who have gripes against him and there are those who have reason for these gripes but one would hope that he is going by procedure for conduct unbecoming an officer and is cooperating with the prosecuters in this. Its also been said that the Chief and Cummings are steadfast friends so why would he want to throw him under the bus? People on this blog have said that this is not news because many on the department complained because of this officers behavior and many were angry because of the perception it gave of the department. We have to look at this as it is, several complaints from those who are said to have video tapes of the escapades and have sworn affidavits to this affect. What needs to be done now is to allow the judicial system to do their job and investigate any and all accusations and to act accordingly. If Cummings is guilty he should be prosecuted to the fullest extent of the law. If the alegations are unfounded then he will have alot of damage control and humiliation to his family. What we need to do is hope this does not destroy his family in the long run and that his kids are able to function without bias.

    #21 Bitching about Cummings’ bail diminishes the validity of anything you say. Chances are- no, I’ll guarantee- that this is Cummings’ first arrest. You know as well as anyone else, and probably better than most, that the Bail Commissioner’s report at arraignment for him was all sweetness and roses, compared to the bunker-buster one for you after, what, a dozen arrests and half as many convictions? I’m guessing but I’m open to hear the facts. Cummings isn’t a flight risk, has very strong ties to the community, was until recently gainfully employed and financially responsible, and will likely spare everyone, including his family and the kids involved, the agony of testifying in a Part A trial.

    So 23 you are telling me that paying 3% on that bond(2,250$) is a fair amount given the gravity of the situation. Yes, bondsmen go as low as 3% on the big numbers if you know them. Im out on 5%, because my loved ones didnt feel like shopping around while I was in BCC.
    He had that time. Once again special treatment.
    Cummings is not my target here.
    If he was really set-up by a bunch of teenagers, then I feel for his pain.
    And if this set-up even goes back to his superior, well then how do we handle that?
    Just trying to point out the inequality within our great nation. This goes well beyond the conduct of just 2 officers.

    Rilling said follow-through and personal commitment, not money, are most important. According to Rilling, gang activity has risen and fallen over the years. When it has risen, community leaders have discussed action.

    not money was an odd thing to tie into this we don’t buy it Harry maybe its time to retire that was friggin lame. Suspended cops, hurt on medical, manpower guarding a prisoner all three shifts at the hospital and most of your officers are not taking overtime tells us money is going to be if not the problem now.

    have to admit it was reported that Harry talked to all three shifts the other day what bothers some is the reporter wrote it as if it was a something he rarely does.

    The mayor is now on chanel 12 saying all the drive by shootings we have had. What is he talking about it is he trying to spread fear himself by talking this way and if he is wrong is everyone going to blame Noelle and ask for the mayor to quit?

    So how many drive by shootings have we had Dick?

    Chief Rilling announced that the police department has used about 65 percent of its overtime budget and we are not at the fiscal year midpoint. Of course, it might be helpful to know if the overtime was the result of one-time events, a trend or how it compares to same period in previous years. This type of basic analysis is something that it seems would be important in the sixth largest city in Connecticut, but strangely always seems to be missing form budget presentations.

    Which is the reason why this article popped up in today’s Hour. Since we are at the start of budget planning for fiscal 08-09, department heads are rallying up the rhetoric on why increases are needed. For the most part, increasing staff to deal with new demands placed on departments is entirely justifiable. But in this case, the police budget, as run by Rilling deserves a much closer look.

    As I drive around town at night, and see our new Police cruisers manning the CL & P, invasive digs, I wonder why there are so many new police cruisers out there idling away. Is CL & P paying all the overtime and use of those police cruisers? And what’s the priority for the department, overtime staffing for Cl & P, or scheduling staff appropriately in the first place? What hours of the day is the overtime being paid out in? Those are my questions at least. The Hour’s Robert Koch reports:

    CL&P pays for the officers and a fee to the city to cover their expenses. Cops are working these sites on their off duty times.
    As far as the budget, it is a yearly ritual. The city knows when they set the police budget it won’t be enough to cover costs. Then there is a special appropriations meeting to authorize money to cover the shortage. Happens every year. Instead of doing a reasonable estimated budget, they cut, and then have to make up for the shortage they knew would happen.

    but when they need manpower the Norwalks overtime is not as welcomed. I guess what you may be missing is where are the figures?

    I think what was brought up as well is who is paying for the cruisers? We have had one for over a week on the bridge at washington street lights on but no one in it who is paying for that? Officers are painting another picture.

    Stamford. Bridgeport, and others have it all broken down in their budgets some are on line but why plaster those all out here its not worth it .

    Why have we never had a breakdown on our budgets?

    Where is it going to show according to police officers there was an overtime budget for three police officers around the clock guarding a suspect at the Norwalk Hospital for over four weeks? His court date was this week what is the deal on that?

    We are hearing now in the news we would of had to hire more police for the high school game friday night I hope that was not a factor in calling the game, most of the officers have declined extra details friday . There would if been a need for up to ten police officers going into the game at the high school friday.

    We are not hearing whats going on right now another news blackout when it comes to these issues.

    where your addressing CL&P and not saying your wrong ,we are asking what about the other issues just in this post alone?

    we are also hearing in the news tonight a force of 160 officers care to explain how many we have on the street? wasn’t it 178 last week how did we lose 18 officers in a week?

    asking that last question was a red herring yet true on the facts

    they are asking for the public help in finding a suspect yet the NPD web site is down not showing the wanted person is it asking too much that they do their job so we can do ours in looking for the stabbing suspect?
